Fatwa and Legal Contracts
We are often asked for sight of our legal contracts and the Fatwa we hold from our Shariah board which governs our products.
These are therefore now available as PDF files.
Until now we have been hesitant about making these legal documents freely available. There are a number of reasons for this including the potential for fraud and the risk that the contracts may be copied and misrepresented. However, the contracts are now in public domain simply by virtue of the number of customers who have taken finance from us. In addition we can understand that the most important thing for our clients is knowing that the product they are taking is in accordance with the Shariah and that they would like to see the contracts prior to making an application.
Please note that the PDF files show only the prime documents being the Diminishing Ownership Agreement, the Lease and the Fatwas governing home finance and buy-to-let. The Diminishing Ownership Agreement explains how the property is jointly held between the bank and its client and how the respective ownership shares change as payments are made. The Lease details the rights and obligations of occupancy while the bank is leasing it's share of the property to our client.
